This Website Terms of Use Agreement (“Agreement” or “Terms”) governs your use of this Internet Site (“Site”) and the products and services offered therein by Bello Dynamic, LLC. Read these terms of Use carefully and indicate your acceptance of them before continuing to use our websites, community forums, services and/or our other products. “Bello Dynamic”, “we,” or “our” means Bello Dynamic, LLC. “Customer”, “member”, “you” or “your” means the person indicating acceptance of this Agreement.
1.0. GENERAL
BELLO DYNAMIC PROVIDES THIS SITE, FORUMS, AND RELATED PRODUCTS, SERVICES AND WEBSITES, SUBJECT TO YOUR COMPLIANCE WITH THE TERMS AND CONDITIONS SET FORTH BELOW AND IN THE PRIVACY POLICY, SAAS SUBSCRIPTION AGREEMENT, ACCESSIBLE VIA A LINK. PLEASE READ THE FOLLOWING INFORMATION CAREFULLY AND INDICATE YOUR ACCEPTANCE OF THE TERMS BY EITHER CLICKING A BOX INDICATING YOUR ACCEPTANCE, OR BY ACCESSING AND USING THE WEBSITES, SERVICES OR PRODUCTS OFFERED.
1.1. Changes to This Agreement
Bello Dynamic may occasionally make changes to this Agreement at any time without prior notice to you other than listing of a later effective date than the one set forth at the top of these Terms. Prior Terms of Use statements will be available upon request. Unless otherwise specified by Bello Dynamic, changes become effective immediately upon our posting a notification within the Site such as the listing of a later effective date at the top of these Terms. As your next use of the Site may be governed by different Terms, we encourage you to look for a new effective date on these Terms each time you access the Site. It is your responsibility to check these Terms periodically for changes. If we make any material changes to these Terms, we may also use reasonable efforts to notify you of the changes through communications via the Customer’s Account, an email to your address of record, when you login to your account, or other communication means. You may be required to click to accept or otherwise agree to the modified Agreement before continuing to use a site, service, or product. In any event, continued use of this site and any Bello Dynamic offering after the updated version of the Agreement goes into effect will constitute your acceptance of such updated version.
1.2. Web Copyright Information and DMCA Notification
The websites, products, and services include copyrighted material, trademarks, and other proprietary information. Unless otherwise indicated, all content on this Site and pages within this Site are the property of Bello Dynamic, its subsidiaries, affiliates or licensees. Bello Dynamic reserves all rights with respect to the content on this Site. No portion of the materials on these pages may be reprinted or republished in any form, including without limitation, all rights to display, select, coordinate, arrange, enhance, modify, remove, alter, copy, create derivative works from, transmit and distribute the content, whether in whole or in part. You may not modify, copy distribute, transmit, display, perform, reproduce, publish, license, create derivative works from, transfer or sell any content of this site in any form without the express written permission of Bello Dynamic.
You agree to not use the Bello Dynamic icons and logos, site address or other means to hyperlink to other Internet sites with any page in this Site (other than the home page: https://konnexu.com or https://community.konnexu.com) without prior written permission from Bello Dynamic.
We comply with the provisions of the Digital Millennium Copyright Act applicable to Internet service providers (17 U.S.C. Se. 512, as amended) (“DMCA”). 1.3. Trademark Notice
“Bello Dynamic”, “Konnexu”, and the “K” logo are trademarks and service marks of Bello Dynamic, LLC, and you must obtain our permission before use of our intellectual property, including our marks. All other trademarks, service marks, logos, product names and company names used in this Site are the trademarks, service marks, or logos of their respective owners. You must obtain permission from those owners before using their marks and logos.
2.0. USE OF SITE
2.1. Use of Cookies
We use cookies, including session replay technology and other website trackers, to personalize and enhance your browsing experience on our website. By using our site, you consent to their use, our Terms of Use, and our Privacy Notice. This website may contain links to other websites and online resources that are not owned or controlled by Bello Dynamic. In addition, we may
provide links to sites of affiliated companies and other businesses. We are not responsible for examining or evaluating the content on these
linked sites and resources, and we do not warrant the offerings of these linked sites and resources nor the content of their websites.
Bello Dynamic does not assume any responsibility or liability for the actions, products, and content of any third-party websites and resources.
You are responsible for carefully reviewing their Terms of Use, Service, and Privacy Statements.
2.4. No Unlawful or Prohibited Use
(A). As a condition of use, you will not access or use this site for any purpose that is prohibited by any laws or regulations, facilitates the violation of any law or regulation, or is otherwise prohibited by these terms and conditions and any other notices on this Site. You will not access or use this site in any manner that could damage, disable, overburden, or impair this site or any asset or property of Bello Dynamic or its subsidiaries or affiliates, or interfere with any other party’s use and enjoyment. Do not use this site, services or products to distribute malware, or for phishing, spamming or sending unsolicited emails.
(B). Crypto currency or coin mining or any virtual currency or coin mining is prohibited.
(C). You may not use our site in relation to denial of service (DOS) attacks or distributed denial of service attacks (DDOS), or any activities related to hacking. By default, all IPs under DoS and DDOS attack will be null routed to protect other servers from the network. You are furthermore prohibited from the use of stress tools to test our network or your server that will degrade the network performance or that may affect other servers within the network.
(D). Do not use this site, services, or products to promote in any matter any content related to illegal drugs, gambling, firearms, pornography, or any illegal, malicious, fraudulent or unlawful activities. You are responsible for your site and server content.
(E). Child Sexual Abuse and Exploitation. We prohibit any sexual content or suggestive content, and predatory or inappropriate behavior involving minors (e.g. users under 18 years old) or someone who appears to be a minor. This includes sharing, offering, or asking for child exploitation content, including child sexual abuse material (CSAM).
NOTICE: Use of this Site, including membership in the Community Forum, is automatically void where prohibited. As a user of this Site, you represent and warrant that you have the right, capacity and authority to enter into this Agreement and will abide by all of its terms and conditions.
Your services may be suspended or terminated at our discretion due to any violation of our terms. Evidence of any possible use of this Site for illegal purposes will be provided to law enforcement authorities.
2.5. Subscription, Product Plans, and Membership
Additional Terms for Subscribers to our products and services, as well as forum memberships are set forth in the Products and Services Order Form and associated Bello Dynamic SaaS Subscription Agreement.
2.6. Billing Services
Bello Dynamic uses a post-billing method wherein payment is required before your use of our services. Although our system sends notification reminders for invoices and billings to your email inbox with a “no delivery guarantee notification” back to us, you remain responsible for keeping your account current, regardless of email notification. Failure to pay any invoices or billings on or before the billing date may result in immediate suspension or termination of the service.
2.7. Cancellation and Refund Policy
All payments are final.
You may opt to cancel your membership and/or subscription services at any time, for any reason. Upon cancellation, your account will not accrue additional charges or fees for the terminated membership or services after the expiration of the prepaid term.

Any memberships, products, or services offered with a money-back guarantee, are only eligible for a refund within the stated money-back guarantee of the initial offer.
Bello Dynamic reserves the right to terminate your membership and/or subscription services at any time, for any reason. If we terminate your membership or subscriptions services because you have breached this Agreement, the Privacy Policy, Bello Dynamic SaaS Subscription Agreement, the Forum Rules, or any other terms related to our services and products, you will not be entitled to any refund of your unused membership, subscription, or service fees. Violation of the terms of these agreements means forfeiture of your claims to any refund. The terms of this agreement survive any termination of your membership or subscription services.
2.8. Maintenance and System Outages.
Bello Dynamic and its affiliates may from time to time conduct routine maintenance, tests, upgrades, and repair to the network, hardware and software on its servers. You acknowledge that there may be instances where we are not able to give advance notice of a service disruption in the event of emergency maintenance, upgrades or repair. We reserve the right to disrupt our services to conduct service restoration and immediate remedial works without prior notice.
3.0. WARRANTY DISCLAMER AND LIMITATIONS OF LIABILITY
3.1. Warranty Disclaimer
Although Bello Dynamic attempts to ensure the integrity and accurateness of the Site, it makes no guarantees whatsoever as to the completeness, accuracy and timeliness of the information contained in the Site. It is possible that the Site could include inaccuracies or errors, or may be or become out of date, and that unauthorized additions, deletions and alterations could be made to the Site by third parties. In the event that an inaccuracy arises, please inform Bello Dynamic so that it can be corrected. Bello Dynamic may make changes at any time. You assume total responsibility and risk for your use of this site and site-related products and services.
Note that Bello Dynamic is not responsible for any bugs in server systems including Operating Systems, panels and scripts. We are not responsible for any bugs in your websites including scripts or applications. Bello Dynamic assumes no responsibility for any interruption, omission, error, delay in operation, deletion, defect, communications line failure, destruction, theft or unauthorized access to, or alteration of any user of member’s communications. We are not responsible for the conduct of any user of the Bello Dynamic websites, or of any member of its services, whether online or offline.
No advice or information, whether written or oral, obtained by you, users or members through or from the Bello Dynamic services themselves, shall create any warranty not expressly stated herein.
THIS SITE, THE INFORMATION AND MATERIAL ON THE SITE, THIS PUBLICATION AND ANY REFERENCES TO PRODUCTS AND SERVICES ARE PROVIDED “AS IS” WITHOUT ANY REPRESENTATION OR WARRANTY, EXPRESS OR IMPLIED, OF ANY KIND, INCLUDING WITHOUT LIMITATION, WARRANTIES OF MERCHANTABILITY, FITNESS FOR ANY PARTICULAR PURPOSE OR NON-INFRINGEMENT. SOME JURISDICTIONS DO NOT ALLOW FOR THE EXCLUSION OF IMPLIED WARRANTIES, SO THE ABOVE EXCLUSIONS MAY NOT APPLY TO YOU.
3.2. Limitation of Liability
YOU EXPRESSLY UNDERSTAND AND AGREE THAT BELLO DYNAMIC SHALL NOT BE LIABLE FOR ANY DAMAGES WHATSOEVER, TO YOU OR ANY THIRD PARTY, ARISING OUT OF OR IN CONNECTION WITH YOUR ACCESS TO, DOWNLOADING OF, OR USE OF THIS SITE OR ANY INFORMATION CONTAINED AT THE SITE OR ANY LINKED SITES. IN PARTICULAR, BELLO DYNAMIC SHALL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, PUNITIVE, CONSEQUENTIAL OR EXEMPLARY DAMAGES, INCLUDING ANY LOST PROFITS, WHETHER AN ACTION ALLEGING FROM SUCH DAMAGES IS BROUGHT IN CONTRACT, NEGLIGENCE, TORT OR OTHERWISE.
Your sole remedy for dissatisfaction with the Site or site-related products and services is to stop using the Site or those products and services.
Notwithstanding anything to the contrary contained herein, Bello Dynamic’s liability to you for any claim, regardless of the form of action, will at all times be limited to the amount paid, if any, by you as a member to Bello Dynamic for the service during the term of the membership.
4.0. GENERAL
4.1. Indemnification
You agree to hold and indemnify Bello Dynamic, and its subsidiaries, affiliates, agents, officers, and other partners and employees, harmless from any loss, claim, liability, or demand, including reasonable attorney fees, made by any third party due to or arising out of your use of the Site in violation of this Agreement and/or arising from a breach of this Agreement and//or any breach of your representations and warranties set forth above. If you are a California resident, you expressly waive California Civil Code Section 1542, which states “A general release does not extend to claims which the creditor does not know or suspect to exist in his favor at the time of executing the release, which, if known by him must have materially affected his settlement with the debtor.
4.2. No Agency.
There is no partnership, employee-employer, agency, franchisor-franchisee, or joint venture, relationship between Bello Dynamic and any Customer or User of the Bello Dynamic services and/or products.
4.3. Force Majeure.
Bello Dynamic will not be liable for, or be considered to be in breach of or default under this Agreement on account of any delay or failure to perform as required by these Terms as a result of any cause or condition beyond our reasonable control.
4.4. Governing Law and Jurisdiction.
You agree that Bello Dynamic is operated in the United States and will be deemed to be solely based in Texas and a passive service for purposes of jurisdictional analysis. Any dispute arising out of or relating to your access to materials and information on, use of, and these terms and conditions will be governed and be interpreted pursuant to the laws of the State of Texas, United States of America (“USA”), without giving effect to any principles of conflicts of law unless superseded by Federal Law. Federal and state courts in the State of Texas USA shall have exclusive jurisdiction over all claims. By accessing or using this site, you consent and submit to the personal jurisdiction and venue of these courts.
4.5. Governing Law Outside of the United States of America.
Bello Dynamic expressly disclaims any representation or warranty that the sites, services, and products comply with all applicable laws and regulations outside of the United States. If you use the sites, services, and products outside of the United States, you expressly understand and agree that you are responsible for determining compliance with different laws, regulations, or customs that may apply in connection with your use of the sites, services, or products.
4.6. Severability
This Agreement, including the Privacy Policy, SaaS Subscription Agreement and Forum Guidelines referenced herein, contains the entire agreement between you and Bello Dynamic. Failure of Bello Dynamic to enforce or exercise any section or provision of this Agreement shall not constitute a waiver of the section or provision. If any part of the terms and conditions of this Agreement is held unlawful, invalid, void or unenforceable, that part will be deemed severable and will not affect the validity and enforceability of any remaining provisions.
4.7. Headings
The section headings of the Agreement are for convenience only and have no legal or contractual effect and will not be considered when interpreting these Terms.
